Welcome to the Voluntary Loan Refund Program
On December 4, 2012, Cash America International, Inc. announced a voluntary program to fully reimburse approximately 14,000 Ohio customers for funds collected in connection with legal proceedings initiated by the Company in Ohio from January 1, 2008 through October 1, 2012 seeking the collection of past due loan amounts owed to the Company. If you have had funds collected as the result of a collections lawsuit for a past due loan with Ohio Neighborhood Finance, Inc., d/b/a Cashland; Cash America Pawn, Inc. of Ohio; Cashland Financial Services, Inc.; Cash America Net of Ohio, LLC; Ohio Neighborhood Credit Solutions, Inc.; and CNU of Ohio, LLC, you may be eligible for a full refund.
Cash America determined that a small number of employees did not prepare some court documents properly in many of its Ohio collections legal proceedings. While the Company believes the filed documents accurately depict the existence and amount of the debts owed to the Company under consumer lending contracts, the preparation and filing of these documents did not always comply with certain court rules.
On May 10, 2013 Cash America began voluntarily reimbursing eligible Ohio customers, who submitted valid claims, all amounts received through collections legal proceedings initiated by the Company in Ohio, from January 1, 2008 through October 1, 2012, plus interest, including the reimbursement of amounts collected in connection with legal proceedings that were not affected by the improper document preparation. Reimbursements were handled through The Garden City Group, Inc. ("GCG") and its claims process. In addition, for all trial court collections proceedings filed in Ohio from January 1, 2008 through December 4, 2012, with the exception of one appellate matter, Cash America filed dismissals, terminated existing post-judgment collections activities, and requested to vacate each judgment entered and/or notified credit reporting bureaus of the vacated judgments, as necessary for each case.
On November 20, 2013, without admitting or denying any of the facts or conclusions made, Cash America agreed in a consent order with the Consumer Financial Protection Bureau to extend the time period in which eligible Ohio customers may submit a valid claim to May 19, 2014.
